(1) If banks and financial institutions fail to recover the amount to be recovered from the debtor, they shall submit a complaint in the prescribed format to the tribunal for the recovery of such amount within the following time limits: (a) In the case of loans that have exceeded the limit at the time of commencement of this Act, this Act shall commence Within five years from the date of occurrence. (b) In the case of overdue loans after the commencement of this Act, within four years from the date of such overpayment. (2) The amount which will be 0.25 percent of the amount claimed by the concerned bank and financial institution when making an application under sub-section (1). (3) Within fifteen days from the date of receipt of the complaint as per sub-section (1), the tribunal shall issue a deadline of fifteen days to the defendant to submit a reply along with evidence for his defense and the defendant shall file a reply within that period. However, due to circumstances beyond the control, if the defendant is unable to submit a reply within that period, the tribunal may extend the period of up to fifteen days, if an application is made within the next fifteen days after opening the reason.
